Antimonopoly regulation – control and mitigation of risks

19.05.2010

A special supplement to Corporate Lawyer magazine entitled Antimonopoly Regulation was published in May 2010. Pepeliaev Group lawyers prepared the supplement jointly with representatives of the Russian Federal Antimonopoly Service and international experts.

The entry into force of the “antimonopoly package” not only brought Russian legislation into line with the provisions of European competition law, but also expanded the authority of the supervisory bodies and introduced more stringent rules on liability for antimonopoly offences. After receiving new legal resources, the Russian Federal Antimonopoly Service tightened control over the pricing of specific product markets and concentrated on combating collusion and the concerted practices of businesses that restrict competition.

Lawyers from Pepeliaev Group (E. Sokolovskaya, D. Bykov, V. Knutova, I. Bolotnov, O. Migitko, K. Sasov, E. Ovcharova, A. Duyunov, S. Nogovitsyna) summarise here the experience of professionals working in different areas of law and describe the issues that arise in antimonopoly regulation from different perspectives and in different businesses. Experts share their views on antimonopoly audits conducted by the federal antimonopoly authorities, as well as the rights and obligations of the parties. They also remind readers about the types of liability stipulated for different violations of antimonopoly legislation. Particular attention is paid to the choice of procedures (judicial or administrative) for protecting violated rights that make appeals most effective. Tax professionals identify tax risks relating to non-compliance with legislation on the protection of competition and the antimonopoly aspects of the new law on the regulation of trade.

In his article American lawyer J. Armstrong seeks to answer the following questions: how far may the state, represented by the supervisory authorities, go when looking into private matters and how can different countries exchange information?

In an interview A. Sushkevich, Head of the Analytics Department of the Federal Antimonopoly Service, outlines the official position on the new regulations and describes plans to amend legislation.

Elena Sokolovskaya, head of Pepeliaev Group’s antimonopoly team, is convinced that “antimonopoly legislation will be improved even more and numerous amendments will appear in legislation to stimulate investments and facilitate business development in Russia”.

Progressive development of antimonopoly legislation and law enforcement practice in Russia enables companies to develop their businesses and allows lawyers to focus on mitigating risks for their clients.
