Recently the lawyers have been raising concerns about dangerous trends of controlling and surveillance bodies as well as courts using lower standards of proving. The subject covers the substantive law issues (what needs to be proved) and procedural law issues (how and by what means the proving takes place). The conference participants will discuss how to change the situation and impose more stringent requirements for standards of proving.
Managing Partner Sergey Pepeliaev will moderate the 1st session: “General assessment of the problem.
Theoretical and constitutional law requirements for the standard of proving. Russian Constitutional Court's position on the obligation of the controlling and surveillance bodies and courts to ensure the proper level of proving.”
