REGULATORY DEVELOPMENTS

The Russian President has signed Federal Law No. 436-FZ dated 28 December 2017, which specifies the procedure for the taxation of controlled foreign companies. Moreover, property tax debt of individuals in place as at 1 January 2015 will be written off.

The Russian Federal Tax Service has developed the formats of a country report and of a notice of membership of an international group of companies as well as the procedures for such forms to be served and completed in electronic form.

The OECD has published a list of countries ready to exchange information with Russia. The list includes 71 countries in total. Many of them agreed to start exchanging from 2018.

On 19 December the Board of the Eurasian Economic Commission approved changes to the Protocol on the Procedure for Imposing Indirect Taxes that provide for a delay in the payment of VAT on goods imported into the free economic zones within Russia from the Eurasian Economic Union.

New approaches to supervisory work allow the Russian Federal Tax Service to maintain the decrease in the number of audits of businesses. Over the first 9 months of 2017 the number of such audits dropped by 23%, and their efficiency improved by 20%. There is a steady decrease (by a further 4%) in the number of court decisions regarding disputes that underwent pre-trial settlement. The efficiency of bankruptcy proceedings is at a high level of 98.5%.

The Russian Federal Tax Service and the Bank of Russia agreed to include in the Agreement on Information Exchange a clause that will allow tax authorities to obtain from the Russian Central Bank reports of financial market institutions as well as information on credit institutions providing bank guarantees. Moreover, jointly prepared draft laws have been considered that enable the Russian Central Bank and the Russian Federal Tax Service to exchange data relating to bank and tax secrecy.

The Russian Constitutional Court has confirmed it is possible to recover tax debts from individuals provided that all other options have been exhausted and that double taxation is ruled out.
