Regulatory developments

The Russian President has:

  • signed a law to ratify the Treaty between Russia and Belarus on harmonising customs legislation and cooperating in the customs area;

    The Russian Government has approved draft resolutions of the Supreme State Council of the Union State to create an Interstate Centre in the customs area.

  • signed a Decree to suspend the effect of the tax treaty with Latvia.

The State Duma has adopted draft law No. 1192314-7, which had been dismissed by the Federation Council (the initiator was the Russian Government). It will enable prosecutors to join any case as a full-fledged party if the litigation can be used for avoiding any required obligations and procedures provided for anti-money laundering, tax, currency or customs legislation, or by the law of the EAEU. Prosecutors will also be able to file claims concerning transactions performed by business entities which are not connected with the state if such transactions were aimed at avoiding the rules listed above.

The Russian Government has:

  • extended the expedited procedure for concluding special investment contracts (SICs);

  • approved the rules for maintaining a list of persons subject to sanctions. Further to an application of a person that has been included in the list, the Russian Federal Tax Service (the “Federal Tax Service”) will restrict/resume access to information from the public information resource of accounting (financial) statements (in Russian, abbreviated to ‘GIR BO’) and will also restrict access to certain information from the Unified State Register of Legal Entities (in Russian, abbreviated to ‘EGRUL’).

 

Practice

Starting from 1 July 2022, 761 taxpayers in Russia have been participating in the pilot project of implementing a unified tax payment.

The Federal Tax Service has:

  • approved the form of the acceptance certificate for work performed (Order No. ED-7-26/691@ dated 28 July 2022);

  • launched, together with Alfa Bank and Gaskar Group, a pilot of a new digital system for mutual settlements between clients and contractors for construction and assembly works.

Prime Minister Mikhail Mishustin has talked in an (interview) about the optimisation of the tax system as an extremely important element of ensuring the financial stability of Russia.

During the Moscow Financial Forum:

  • The Ministry of Finance and the Federal Tax Service have presented an analytical system “The effectiveness of benefits” which is based on the Nalog-3 Automated Information System;

  • The Federal Tax Service, the Federal Service for Financial Monitoring (in Russian, abbreviated to ‘Rosfinmonitoring’), the Association of Banks of Russia and non-governmental associations have agreed to cooperate in the framework of a pilot project to create a platform for restructuring business debt.
