Aspects of central and municipal government control have been clarified

The Russian Government’s Decree No. 1234 dated 11 September 2024

Comes into effect on 21 September 2024.

Amendments have been made to the Russian Government’s Decree No. 336 dated 10 March 2022 concerning specific aspects of central/municipal government control. In particular, the possibility has been stipulated for:

  • a non-scheduled control/supervisory activity to be held:
    • with the approval of the prosecutions department, if facts come to light of entrepreneurial activity being conducted without a notification;
    • without notifying a controlled person, if risk indicators have been identified in relation to the mandatory labelling of products within the scope of federal state control/supervision in the field of protecting consumers’ rights;
  • additional situations in which work orders are issued based on the outcome of control/supervisory activities, without any interaction;
  • within mandatory preventive visits:
    • the inspector must, no later than 3 months from the date of the statement that the visit cannot be conducted, issue a decision to make a similar visit without a notification being sent to the controlled person;
    • conduct such visits within the time limit of 10 business days (with an extension being possible, but not beyond the established timeframes).

Also set out are the aspects of organising and performing state control (supervision) and municipal control if the regime of a counter-terrorist operation is enacted (the text is not provided).

A simplified confirmation of conformity procedure has been extended for imported / released products

The Russian Government’s Decree No. 1196 dated 31 August 2024

Came into effect on 31 August 2024.

Amendments have been made to Annex No. 18 to the Russian Government’s Decree No. 353 dated 12 March 2022 on the specifics of permission-based activities in Russia.

Among other things, the following is permitted until 1 September 2025:

  • to import the products that are to be circulated solely in Russia without labelling, including labelling with the Eurasian Conformity mark and the conformity mark;
  • to use a simplified procedure for assessing whether products conform to compulsory requirements in the form of certification / declaration of conformity when products are released for circulation in (imported into) Russia.


Rospatent will be entitled not to publish information about owners of IP

The Russian Government’s Decree No. 1209 dated 2 September 2024

Comes into effect on 30 September 2024.

Amendments have been made to specific aspects of permission-based activity in Russia (see the Russian Government’s Decree No. 353 dated 12 March 2022). It has been established that, until 31 December 2025, Rospatent will not publish in the official bulletin the information about:

  • a person who has filed an application for IP and means of identification to be registered by state authorities;
  • an owner of exclusive rights;
  • the parties to an agreement to dispose of exclusive rights to IP and means of identification.

The above persons must file an application to this effect with Rospatent.
