Public discussions are now taking place.
It has been proposed that the provisions of the Civil Code be clarified concerning a fee for withdrawing from a contract, namely: the amount of the fee and the procedure for paying it will be determined by an agreement of parties. This is, among other things, irrespective of whether or not such a fee is proportionate to the obligation.
It is planned that the articles of the Code that regulate certain types of agreements and contracts (such as a fee-based contract for services, a freight forwarding agreement or a trust management agreement) provide for parties to be able to determine other grounds/ consequences of a refusal to perform obligations.
