The rules will be adjusted of how coercive measures apply

Draft federal law No. 876963-8

The draft has been put before the State Duma.

In particular, it has been proposed that amendments to Federal Law No. 281-FZ “On special economic measures and coercive measures” dated 30 December 2006 stipulate that:

coercive measures:

  • apply to the organisations and individuals listed in the resolutions adopted by the UN Security Council or those included in the sanctions list further to a resolution of its subsidiary bodies;
  • include but are not limited to measures that involve the freezing (blocking) of monetary funds and other assets which apply:
    • in relation to the whole property, including property in joint ownership;
    • without any delay;
    • without a person being informed in advance (including when financial transactions/dealings are banned).


LEGISLATION

Subjects of critical information infrastructure are obliged to use Russian software

Federal Law No. 58-FZ dated 7 April 2025

Comes into effect on 1 September 2025.

Amendments have been made to Federal Law No. 187-FZ “On the safety of the critical information infrastructure of the Russian Federation” dated 26 July 2017. The purpose is to ensure the technological independence of subjects of critical information infrastructure (CII subjects) via a transition to the predominant use of Russian software and to improve the mechanism for classifying CII subjects.

In particular, provision is made for the following:

  • The Russian Government will adopt:

    • requirements for hardware and software used on significant items of CII;
    • specific industry aspects of categorising items of CII (subject to the approval of the federal executive body);
    • lists of standard industry-specific items of CII;
    • procedure and timeframes for CII subjects to make the transition to the use of Russian software, and combined hardware and software tools, and for monitoring such transition;

  • CII subjects must:

    • within significant items of CII use the Russian software included in the register and used in accordance with the requirements for the protection of information and comply with the requirements for hardware and software tools;
    • cooperate on a permanent basis with the State System for Detecting, Preventing and Liquidating the Effects of Computer Attacks under the established procedure.
Before the types of standard industry-specific items of CII are determined along with the industry specifics of categorising items of CII, the categorisation must be conducted under the procedure established by the Government.

The President has signed the following federal laws:

  • enshrining electronic proceedings in the Russian Code of Administrative Offences ( No. 59-FZ dated 7 April 2025 and No. 60-FZ dated 7 April 2025);

  • extending the list of resources where it is prohibited to place advertising ( No. 72-FZ dated 7 April 2025, please see Pepeliaev Group’s comment);

  • cracking down on cybercrimes. The amendments are aimed at preventing and combating crimes committed using information technologies. In particular, a special state information system is created to identify and prevent such activities. Suspicious actions will be blocked and information about potential crimes will be sent to law enforcement authorities. Mass/automated telephone calls should be made with the prior consent of a subscriber ( No. 41-FZ dated 1 April 2025).
