The law on strengthening administrative liability for environmental offences has taken effect Pepeliaev Group advises that on 17 June 2019 amendments took effect. They include changing the text and supplementing articles 8.2 and 8.4 with new provisions as well as introducing new heads of administrative offences (8.51 and 8.411) in the area of handling production and consumption waste.

Rules for developing technological standards are approved

Pepeliaev Group advises that on 15 April 2019 the Rules for developing technological standards relating to emissions/discharges of pollutants take effect. They are approved by the Russian Government's Resolution No. 89 dated 14 February 2019.

Requirements have been approved for creating a system of automatic control of emissions/discharges of pollutants

Pepeliaev Group advises that in March 2019 the Russian Government has adopted a number of regulatory instruments setting the requirements for creating a system of automatic control and requirements for equipment and for technical tools to measure, record, document and transfer the information about emissions/discharges.

Upcoming changes in the legal regulation of an environmental expert review Pepeliaev Group advises that a public consultation is currently being held with regard to the draft law prepared by the Russian Ministry for the Protection of the Environment and Natural Resources. The draft law provides for a fundamentally new definition of the item that is subject to a state environmental expert review as well as certain other changes in the legal regulation of a state environmental expert review.

Transformation of environmental charges

Pepeliaev Group advises that a draft law has been made available for public discussion. This draft law provides for the charge for a negative environmental impact to be replaced with an environmental tax, and for environmental and recycling fees to be replaced with a recycling fee, with the new payments being introduced into the Russian Tax Code.

Liability for the violation of the rules for waste treatment is planned to become more stringent

The Ministry of Natural Resources and Environment of the Russian Federation has prepared a draft law “On amending the Russian Code of Administrative Offences” which proposes to supplement articles 8.2, 8.4 and 8.6 with new articles and to introduce new heads of administrative offences (articles 8.2.1, 8.2.2, 8.2.3, 8.5.1 and 8.41.1) in the field of treating production and consumption waste.
