Rules for the use of land and development in Moscow have been approved

Pepeliaev Group advises that the Government of Moscow has approved the Rules for the use of land and development in the city of Moscow*. Two documents underpinning city planning are currently in force in Moscow: the General Plan, and the Rules for the Use of Land and Development.

The approved rules for the use of land and development are published on the official website of the mayor of Moscow**.

Consequences of the Rules for the Use of Land and Development being approved

After the Rules have been approved, any city-planning activities in Moscow, including the construction or reconstruction of buildings or structures, must be performed only within the limits approved by the Rules.

For the whole territory of Moscow (except for Troitsk, Shcherbinka and the territory of the Skolkovo Innovation Centre, for which separate documents are being prepared), the rules for the land use and development establish:

• types of permitted use of land plots and capital construction facilities;
• limits of the permitted construction and reconstruction of capital construction items, particularly the development density, maximum number of floors or the maximum height of buildings and the maximum floor area ratio within a land plot.

PG's comment: Land users should pay particular attention to a possibility of the permitted use of land plots being changed in accordance with the approved rules for the use of land and development. They should bear in mind that it is possible that, previously, the type of permitted use was based on how facilities located in the land plots were actually being
used.

We recommend all developers and land users to familiarise themselves with the approved rules for the use of land and development for the purpose of identifying changes which may affect plans regarding projects
being implemented or land plots being used.
