The rapid development of medical technologies has turned human tissues, organs and cells into a key resource. In relation to biomaterials, de facto contractual and other legal relationships are emerging. However, regulation does not provide a clear answer to the question of what biomaterial is from a legal perspective: can it be sold or bequeathed, and can it be reclaimed from a third party’s possession? Is biomaterial a thing or an intangible benefit, and how do personal data and intellectual property regulations affect the circulation of biomaterials? These and other issues will be discussed during the session.
