15 January 2017 is the deadline for a private employment agency to file its annual activity report for 2016

Law firm Pepeliaev Group would like to remind you that private employment agencies (“PEAs”) should, before 15 January 2017, file a report with the Federal Labour and Employment Service (also known by the Russian abbreviation “Rostrud”) on their activity in relation to supplying employees (staff) on an agency basis in 2016*. 

Failure to file the report in due time or stating information known to be false in the report is a ground for withdrawing a PEA’s accreditation and for excluding it from the register**. Further, when information known to be false is stated in the report, a PEA will be permitted to reapply for accreditation only in one year's time***.

If a PEA’s accreditation is withdrawn then problems may arise not only for itself, but also for companies that use its services, since a PEA that has no valid accreditation cannot continue to supply temporary staff to its clients.

According to a non-official opinion of Rostrud’s officials, 15 January 2017 is the deadline before which Rostrud should receive an annual report from PEAs for 2016. This means that a PEA when sending the report by post should take into account the timeframe for delivery, so that the report is delivered to the accreditation authority no later than 15 January. Rostrud’s representatives have also stated that they will not accept annual reports dated 31 December 2016 or earlier since in this case the calendar year has not yet finished.

Implications for companies


Since PEAs' annual reports are filed centrally with Rostrud, which is located in Moscow, PEAs, especially regional ones, need to think over the logistics for having their annual report be delivered in due time. Since 14 and 15 January 2017 fall at the weekend, we recommend filing the annual report with Rostrud’s mail room no later than on Friday, 13 January 2017.

We would again like to draw your attention to the fact that if the report is delivered to Rostrud with a delay or contains incorrect information then a PEA's accreditation may be withdrawn, which will entail negative consequences not only for agencies, but also for companies that use their services.
