On 30 April 2013, the deadline expires for employers to submit applications that they need foreign employees for 2014

Pepeliaev Group reminds companies which are planning to hire foreign employees for 2014 that they must submit an application that they require foreign employees (the “Application”) by 30 April 2013 at the latest.

Sending the Application in good time is a necessary condition precedent to ensure that a quota may be obtained for hiring foreign employees to carry out employment activity and subsequently to gain permission to hire and make use of foreign employees in 2014. In addition, regrettably, taking part in the application campaign does not guarantee that quotas will be granted and therefore migration permits received. 

Employers that need to amend quotas they have already obtained for the current year (2013) may also submit the corresponding Application before 30 April. 

To file an Application, employers should take the following principal actions:

  • register their company at the site www.migrakvota.gov.ru;
  • complete an electronic application at the site;
  • print out two copies of the completed application;
  • send the printed application to the proper authority of the constituent entity of the Russian Federation where it is proposed that foreign nationals will undertake employment activity.

Please note that there being a quota and permission to hire foreign employees is a condition both under employment and civil law contracts for engaging foreign nationals to perform employment duties. 

The requirement for an employer to have a quota does not apply to qualified specialists in a list of roles that is confirmed annually , or to highly qualified foreign specialists (HQSs). 

In addition, we recommend employers checking how long foreign employees’ current permission documents will remain in force. This will allow employers to plan in advance  the actions they need to take to document employment relationships with those employees, including terminating employment contracts.
