The scope of antitrust immunity in the field of intellectual property may be set out in greater detail

The draft federal law

Public discussions are now taking place.

Specifically, it has been proposed that:

  • the provisions of Federal Law No. 135-FZ dated 26 July 2006 “On the protection of competition” be extended to activities that involve exercising exclusive rights to results of intellectual activity / means of identification (article 10(4)), as well as to agreements for such rights to be disposed of / granted (article 11(9)), if such actions / agreements at the time when goods are launched into circulation are aimed at preventing, restricting or eliminating competition on the market and have not been recognised as acceptable;

  • it should be codified that:

    • a business entity cannot be recognised as having a dominant position on the sole ground that such entity has exclusive rights to results of intellectual activity / means of identification;

    • The Government may establish in what situations it is permitted to enter into agreements connected with using results of intellectual activity.

The opportunity to enter into agreements to restrict prices may be extended

The Russian Government’s draft decree

Public discussions are now taking place.

Amendments have been proposed to the Russian Government’s Decree No. 662 dated 26 April 2023 regarding the right of regions to enter into agreements with business entities to stabilise prices.

Specifically, the Government wishes to extend the effect of the document until 31 December 2029.

 

LEGISLATION

The Government has amended the rules:

  • for compiling and maintaining the register of Russian industrial products (see the Russian Government’s Decree No. 719 dated 17 July 2015). Registry entries formed based on reports from an expert review will have effect for the compliance period stated in the documents, but for no more than 5 years ( Decree No. 1182 dated 7 August 2025);

  • for submitting information to be included in the state information system relating to industry (the Russian Government’s Decree No. 1604 dated 21 December 2017). In particular, those active in the field of industry have the right to provide such information by filling in electronic forms in an organisation's process management tools provided for by the software classifier ( Decree No. 1175 dated 5 August 2025).
