Elena Sokolovskaya spoke at the Antimonopoly Forum held by the Russian Corporate Counsel Association
On 13 March, the Non-profit Partnership Corporate Counsel Association held its annual Antimonopoly Forum supported by the Russian Federal Antimonopoly Service (“FAS”). The experts discussed the most topical issues of antimonopoly legislation and the development of competition: The national plan for the development of competition 2021 - 2025, the correlation between antimonopoly regulation and intellectual property, the assessment of economic concentration transactions, the experience of international cooperation and international transactions, the definition of a dominant position and of a natural monopoly entity, and anti-competitive coordination of retail prices.
Elena Sokolovskaya, Partner at Pepeliaev Group, spoke about whether coordination of retail prices may be permissible and under what conditions. Elena stressed that the fifth antimonopoly package, which was submitted to the Russian Government as far back as last year, directly establishes that price coordination may be recognised as permissible. The new development with regard to coordination concerns an addition to article 13(1) of the Law "On the protection of competition".
