Pepeliaev Group at AEB's tax conference: experts discussed the prospects of deoffshorisation

On 23 April 2014, Rustem Ahmetshin, Senior Partner of Pepeliaev Group, took part in the conference 'Prospects of deoffshorisation: Consequences for Russian and foreign companies', which was organised by the Tax Committee of the Association of European Businesses (AEB).

During the conference, participants discussed a draft law regarding taxation of 'controlled foreign corporations', how to determine the beneficial owner of income, the consequences of ratifying the Convention on Mutual Administrative Assistance in Tax Matters, as well as how the national legislation on tax avoidance is related to international treaties.

Rustem gave a speech on 'Tax residence for legal entities - practical consequences for business' at the end of which he concluded that the new residence rules, though reasonable, are utterly new for the Russian business world. Moreover, they also give rise to a high risk of double taxation for companies.  In addition to the above, in the absence of domestic doctrine and practice, this gives rise to a high risk of legal uncertainty and abuse of power on the part of administrative, judicial and law enforcement authorities.

Sergey Shatalov, Russia’s Deputy Finance Minister, also talked about his attitude to the new draft tax law during the round table discussion. Vadim Zaripov, Deputy Head of AEB's Tax Committee and Head of Analytical Department of Pepeliaev Group, moderated the event.

Also, as a part of the conference, a round table discussion was organised, featuring Daniil Egorov, Deputy Head of the Federal Tax Service, and experts of AEB's Tax Committee.
