Valentina Orlova participated in Rospatent's international conference "Formation of the intellectual property ecosystem”.

The Head of the IP and Trademarks Practice at Pepeliaev Group, Valentina Orlova, participated in the international conference "Formation of the intellectual property ecosystem" held by Rospatent (as Russia's Federal Service for Intellectual Property is commonly called) on September 29 and 30.
 
Ms Orlova spoke within the framework of the strategic session "Transforming the business climate: Rospatent's lawmaking initiatives.” Among the experts present were: Dmitry V. Travnikov, Head of the Rospatent’s Department;  Daria N. Shipitsyna, Adviser of the Federal Institute of Industrial Property (abbreviated in Russian as FIPS); Ildar A. Shaikhutdinov, CEO of the Institute for Financial Development of Business; Anna S. Rogoleva, Deputy Head of Rospatent’s Administration; Georgy Z. Kotlyar, Deputy Director of the Department of Strategic Development and Innovation of the Russian Ministry of Economic Development; Vadim O. Nyunyaev, Head of the Intellectual Property Division at PJSC Gazprom Neft; Natalia I. Zolotykh, Vice President of the All-Russian Public Organization of Small and Medium Enterprises "Support of Russia"; Boris V. Gerasin, Head of the Patent Division of Sberbank; Olga L. Alekseeva, Head of the FIPS Quality Monitoring Centre;  and Maria N. Bogomolova, Head of the Intellectual Property Practice at PJSC Sibur.


Within the framework of the module "RESTRICTION ON THE REGISTRATION OF TRADEMARKS CONTAINING GEOGRAPHICAL DESIGNATIONS," Ms Orlova, answering the moderator's question "Why do the existing restrictions on the registration of trademarks not allow you to effectively combat bad-faith practices?", expressed the opinion that the existing restrictions on trademarks "with geography" are enough to combat such practices effectively, and sometimes even excessive. Such restrictions are regulated by the provisions of articles 1483, 1488 and 1489 of the Russian Civil Code. They are quite successfully applied by both Rospatent and the courts. Redundancy in regulation consists of the fact that the restriction established by article 1483(7) of the Russian Civil Code applies to any goods, and not only homogeneous, which does not seem to meet the interests of all participants equally. In this regard, it is necessary to take into account the provisions of the Geneva Act of the Lisbon Agreement (in particular, article 11) when preparing proposals for improving legislation.  

The event was held in a hybrid format (offline and online). 166 speakers delivered reports, including speakers 12 from foreign countries.
