The XII Siberian Tax Forum has been held in Kemerovo

On 13 October, the XII Siberian Tax Forum was held in Kemerovo. It was organised by Nalogoved and the Institute of Law of the Kemerovo State University with expert legal support from Pepeliaev Group. More than 110 people attended the Forum.

The Siberian Tax Forum was opened by the event’s organisers: A. Yu. Prosekov, Rector of the Kemerovo State University, S. O. Gavrilov, Director of the Institute of Law of the Kemerovo State University, and V. M. Zaripov, Deputy Editor-in-Chief of Nalogoved, who all gave their welcome speeches.

The first session was dedicated to the legal framework of tax optimisation. The participants discussed the Law on tax abuses, the risks that might arise when a business is being split up and the issue of the actual right to income when international agreements are applied. The participants who took part in the discussion were: A. L. Potapov, Presiding Panel of the State Commercial Court of Kemerovo Region, N. A. Shipitsina, Head of the Department for Methodology of Bookkeeping and Accounting and Tax Matters of the Finance Division of TechnoNICOL Coproration, E. Yu. Goloborodova, Head of Tax Relations of Raspadskaya coal company, and E. A. Lysenko, Head of Siberian Office of Pepeliaev Group.

The second session was devoted to tax administrations and tax disputes. Under discussion were the key decisions of the Russian Constitutional Court with regard to taxes, the practice of general jurisdiction courts on collecting tax arrears and the imposition of administrative liability for tax violations, possible ways to prevent tax offences, the problems of proof when tax cases are being resolved out of court, as well as a number of other topics. Among the participants in the discussion were: E. V. Taribo, Head of the Russian Constitutional Court’s Administration of the Constitutional Framework of Public Law, O. V. Grechanskaya, judge of the central Court of the Kemerovo District, E. P. Latyshenko, the Authorised Council on Protecting the Rights of Entrepreneurs for the Kemerovo Region, O. O. Boykova, teacher of the Institute of Economics and Management of the Kemerovo State University, Yu. A. Doroshenko, CEO of KOLTA and Chairman of the SME Committee of the Kuzbass Chamber of Commerce and Industry, and V. A. Syrbo, a senior teacher of the Civil Law Department of the Kemerovo State University.

The closing session of the Forum was dedicated to the practice of the collection of tax debt. The discussion touched upon the issues of a sham and an actual sale of a business. A detailed overview was given of the case of the company ‘Korolevskaya Voda’, property liability of business owners and executives, and the practice of imposing criminal liability for concealing property from taxation, as well as other topics. Among the discussion participants were: T. G. Lukyanova, Presiding Judge of the State Commercial Court of Kemerovo Region, T. G. Umyskova, a judge of the Kemerovo State Commercial Court, S. V. Vakhrushev, Deputy Head of the Kemerovo Tax Office of the Russian Federal Tax Service, F. F. Suleimanova, Head of the Third Investigations Department of the Kemerovo Office of Investigations, and Yulia Litovtseva, Head of Practice, Bankruptcy and Anti-Сrisis Protection of Business at Pepeliaev Group.

To wind up the Forum, there was a knowledge-based quiz ‘Professional's Library’. The prizes were books on taxes and law published with the support of Pepeliaev Group. The special prize was unlimited access to the electronic versions of the journal Nalogoved from 2004 to date.
