It follows from the case files that the Constitutional Court has considered (see its Resolution No. 5-P dated 24 March 2015), that a Mr Bogatyrev, an individual, purchased an apartment in a house-building cooperative under a sale and purchase contract. That contract was concluded based on the results of an auction to sell property that had been seized. After his ownership of the apartment was registered, Mr Bogatyrev learnt that the former owners retained the right to dispose of the residential premises.
