Preparation of an opinion on environmental issues in connection with the decision of the authorised body to register facilities that have a negative impact on the environment

Written advice for one of the top 50 pharmaceutical companies in the world on the following matters:
  • assessing whether the authorised body has lawfully registered the company's facilities as having a negative environmental impact and assigned category III to them; 
  • identifying the requirements of environmental legislation that apply to the company in the situation at hand;
  • providing recommendations regarding the company’s further actions (filing an administrative/judicial appeal against the authorised body’s decision, amending information about the registered facilities, etc.);
  • assessing the prospects of and providing recommendations regarding the administrative case (taking into account the lack of detailed information about the imputed offence);
  • assessing how the change of the company’s code in the official classification of economic activities (known in Russia by the abbreviation OKVED) and the construction of a laboratory affect the company’s position in the register of facilities having a negative environmental impact.
The result of this project was our recommendations for further actions of the company (appealing the decision of the authorised body by way of an administrative/judicial procedure, a change of the information about the registered facilities, etc.) and an assessment of prospects and provision of recommendations with respect to the administrative offence case (taking into account the lack of detailed information about the imputed offence).
