A draft law has been put before The State Duma to reform the system of extended producer responsibility (epr)

On 25 April 2023 a draft law was submitted to the State Duma which provides for significant amendments to Federal Law No. 89-FZ “On production and consumption waste” dated 24 June 1998 with regard to the extended responsibility of producers.

The Constitutional Court has obliged public authorities to pay interest on a efund of the recycling charge which has been collected in excess The Russian Constitutional Court has held that if the recycling charge has been collected in excess the relevant amount should be refunded with interest. The same rule which applies to the refund of taxes should apply in this case.

The government has established requirements for handling animal by-products

On 3 November 2022, the Russian Government’s Resolution No. 1940 dated 31 October 2022 was published, which establishes requirements for the storage, processing, reprocessing, transportation, sale and use of by-products of animal farming in agricultural production.

The government has approved the list of violations that will result in animal by-products being recognised as waste

The Government has published its Instruction No. 3256-r dated 31 October approving the list of violations of the rules for handling animal by-products (ABP), which will result in such by-products being recognised as waste.

A law has been adopted on using waste from the use of subsoil resources Federal Law No. 343-FZ has been published that allows users of subsoil resources to extract minerals and valuable components from waste from the use of subsoil resources and to use such waste in different ways.

A law has been adopted on the handling of secondary raw materials Pepeliaev Group advises that, on 14 July 2022, a law was published that determines the legal regime for secondary resources, secondary raw materials and industrial by-products.

A law has been adopted that contains mechanisms for blocking the actions of foreign companies that may pose a threat to the uninterrupted and rational use of subsoil resources or of facilities of cross-border gas transportation infrastructure Pepeliaev Group advises that on 6 July 2022 the State Duma of the Federal Assembly of the Russian Federation adopted a Law that provides for a mechanism for the mandatory transformation of a branch (representative office) of a foreign company whose activity relates to using subsoil resources into a Russian limited liability company (an LLC), and for a mechanism limiting the rights of foreign investors having membership of a Russian company whose activity relates to using subsoil resources.

A law has been signed to the effect that only Russian persons may use subsurface resources The Law was signed and officially published on 28 June 2022. It provides that foreign persons no longer have the right to use subsurface resources in the Russian Federation.

The Russian Federal service for supervision of natural resources will perform unscheduled audits of companies that disposed of waste in 2020 Pepeliaev Group advises that the deputy Chairman of the Russian Government Viktoria Abramchenko has instructed the Russian Federal Service for Supervision of Natural Resources to carry out unscheduled field audits of legal entities and individual entrepreneurs who in 2020 disposed of waste from the use of goods based on agreements concluded with producers and importers of goods and packaging.

The Ministry of Natural Resources and the Environment of the Russian Federation has developed a new procedure for taking an inventory of emissions of pollutants into the atmosphere and the sources of them Pepeliaev Group advises that the Ministry of Natural Resources and Environment of the Russian Federation (the “Ministry”) has drafted a new “Procedure for taking an inventory of stationary sources and emissions of pollutants into the atmosphere, adjusting the data of such inventory and documenting and storing data obtained by taking such inventory and making adjustments” (the “Procedure”).
