With the adoption of Federal Law No. 35-FZ dated March 12, 2014, amending parts one, two and four of the Civil Code, other items of Russian legislation, the legal regulation of trade names continues to be developed. To some extent, the changes represent an improvement.
Based on Federal Law No. 89-FZ 'On manufacturing and consumption waste' dated 24 June 1998 and with a view to safeguarding the interests of Russian car manufacturers in conditions where import duty rates for cars were being reduced, the Russian government published its Resolution No. 870 dated 30 August 2012 'On a recycling fee for wheeled vehicles.' This resolution set recycling fees that importers were to pay on top of import duty when importing cars into Russia.
 The Finance Ministry has decided to grant a 2-year amnesty for offshore companies that have Russian owners if they move their assets to Russia. The draft law drawn up at the Finance Ministry forms part of a large-scale deoffshorization program. Under the draft law developed by the Finance Ministry jointly with the Economic Development Ministry, penalties and fines for tax evasion will apply to Russian owners' offshore companies only starting from 2017.

Some time ago, the Russian Constitutional Court set out the principle of a stable business environment. This principle stipulates that "for the purpose of planning its business activities, a taxpayer should be informed in a timely manner about the structure and content of his tax liabilities, so that it may take into account in good time the expenses it may incur on such business activities.

Merging courts: Change will come

It is beyond doubt that merging the Russian Supreme Court and the Russian Supreme Commercial (‘Arbitration’) Court will affect the way all cases are considered, antimonopoly cases among them. This change can be attributed less to different approaches of the lawyers, i.e. the judges of one of the highest judicial institutions of the country, than to other factors which are responsible for the huge impact that the Russian Supreme Commercial (‘Arbitration’) Court has had over an extended period on how economic relations are regulated in Russia.

In December, in his annual address to the Federal Assembly, Vladimir Putin announced measures to ‘deoffshorize’ the Russian economy. It is beyond doubt that significant public resources will be allocated to ensure that the Russian President’s wishes become reality.
