Pepeliaev Group’s lawyers have saved over RUB 3 billion in assets for clients in a dispute over secondary liability

Our team from the Bankruptcy and Anti-Crisis Protection of Business Practice has consolidated its success in one of the key disputes within the scope of an integrated project that involved providing legal support in three bankruptcy cases. Thanks to our success in defending six clients (individuals and foreign companies) in a dispute over secondary liability, we managed to save assets for them that totalled over RUB 3 billion. Our specialists secured that the claims were dismissed in full in relation to five of the persons who had instructed them and had the claims reclassified as losses for the debtor’s former owner, thereby having the amount of liability reduced by more than 25 times.

Such an astounding result was made possible owing to a meticulous analysis of the debtor’s business operations, with the actual reasons for bankruptcy being identified as international economic factors and over a dozen standalone disputes being settled under the debtor’s bankruptcy case. It is of crucial importance that, in addition to our defence against the life-long multi-billion rouble liability, we managed to safeguard our clients’ business reputation.
