Pepeliaev Group’s lawyers have protected a client’s business

THE CORE ISSUE

The client’s business of managing apartment buildings came under threat when a competing company took an interest in it. The competitor found support among the local administration’s officials, who, without the proper grounds, announced a tender to select a management company to manage the apartment buildings.

The team from our bankruptcy and anti-crisis protection of business practice was tasked with protecting the client’s business by having the tender declared invalid, together with the management agreements concluded with the competitor following the tender.

WHY THIS WAS CHALLENGING

The defence was made complicated by the fact that the local administration was prepared to do everything it could to defend the unlawfully organised tender, including “simulating” compliance with the procedures preceding the selection of a management company and submitting documents that allegedly “confirmed” it had complied.

WHAT WE DID AND THE OUTCOME

Pepeliaev Group’s lawyers prepared a legal position and assembled a body of evidence that convinced not only the court but also the opposing party. The latter ultimately realised that continuing to fight would be futile, so it handed the “reins of management” back to the client.

As a result of successfully defending the client, we not only preserved its business but also gave back to the residents of the buildings the management company that they had twice chosen for the quality of its services.

Nor are these just empty words: the residents’ applause after the court announced the operative part of its judgment was the best reward for our work.
