On 21 April 2020 the Praesidium of the Russian Supreme Court approved its Review No. 1 of certain issues of case law associated with the application of the legislation and measures on preventing the spread of the new coronavirus infection (COVID-19) in the Russian Federation
According to the clarifications of the Russian Supreme Court (the “Supreme Court”), if a debtor is included in the list of entities covered by the moratorium, this is a sufficient ground for a bankruptcy petition relating to such debtor to be returned based on article 9.1(1 and 2) of the Law on bankruptcy. The Supreme Court has emphasised that at the stage when the petition is accepted, the court does not investigate the circumstances and the period when the debt arose.
On 15 April 2020, the Moscow City Government adopted Resolution No. 405-PP “On amending the Moscow City Government’s Resolution No. 212-PP dated 24 March 2020”.
Information Letter No. IN-014-12/71 of the Bank of Russia dated 17 April 2020 “On the application of individual provisions of the Bank of Russia’s regulations relating to currency control during the period between 30 March 2020 and 1 July 2020” has been published.
