It is often the case that the majority of IP assets are not included in the bankruptcy estate during bankruptcy proceedings. This is primarily attributable to the specific legal nature of exclusive rights to the results of intellectual activity and means of identification, the difficulties involved in the disposal of a number of assets and, in some cases, the impossibility of identifying such assets.
On December 8 2009 the Supreme Arbitrazh Court ruled that the use and administration of unauthorized domain names constitute an infringement of rights in a corporate name.
Unfortunately more and more companies are finding these days that labor and migration audits are part and parcel of the business landscape in Russia. The authorities have publicly proclaimed their intention of protecting business. However, to date such statements of intent have not been matched by actions.
The issue of the liability of the state authorities for damage caused to business is relevant today. We have seen a considerable number of examples where the state authorities inflicted substantial damage on enterprises and companies through unlawful actions.
