Pepeliaev Group advises that, starting from 1 April, Federal Law No. 69-FZ dated 1 April 2020 “On protecting and encouraging capital investments in the Russian Federation” came into force. The Law regulates relationships in terms of investments that are made based on an agreement for the protection and encouragement of capital investments. At the same time, amendments have been made to the Russian Tax and Budgetary Codes (respectively, Federal Laws No. 70-FZ and No. 71-FZ, both dated 1 April 2020).

Pepeliaev Group advises that, starting from 3 April 2020, a Resolution of the Russian Government has come into force. It sets out the specifics of applying financial sanctions to developers and construction stakeholders as well as other measures of liability for the non-performance or improper performance of obligations under shared construction agreements (“SCAs”).

Pepeliaev Group advises that on 31 March 2020 the Russian Ministry of Finance sent Letter No. 03-08-06/25267 to the Cyprus Ministry of Finance through diplomatic channels. The Letter contains a draft of the Protocol to the Double Taxation Treaty that provides for a significant amendment of the taxation procedure with respect to dividend and interest income.
