On 6 June 2014, Rossiyskaya Gazeta published a Letter of the Russian Ministry of Labour and Social Protection (the 'Ministry') in relation to joining the Russian Aviation Industry Agreement for 2014-2016 (the 'Agreement').

The State Duma has passed in the second reading a set of amendments to the Land Code
Pepeliaev Group advises that on 23 June the Federal Law No. 171-FZ “On amending the Russian Land Code and certain items of Russian legislation” was adopted to the extent of improving the procedure for state and municipally-owned land plots to be provided. This Federal Law enters into force on 1 March, 2015 except for particular provisions.

The Russian Supreme Commercial ('Arbitration') Court provides explanations concerning VAT
Pepeliaev Group advises that on 30 May 2014 the Plenum of the Russian Supreme Commercial ('Arbitration') Court adopted a Resolution concerning issues arising when VAT is being charge. With this explanation adopted, significant changes will be introduced to the practice of implementing chapter 21 "Value-added tax" of the Russian Tax Code. Please note the most important provisions of the Resolution which entail material risks or create fresh opportunities.

The Russian Ministry of Economic Development has set the conditions for foreign goods to be admitted to take part in state and municipal procurement.
Pepeliaev Group advises that on 1 June 2014, Order No.155 of the Ministry of Economic Development dated 25 March 2014 ‘On the conditions for releasing goods originating from foreign states for the purposes of purchasing goods, work and services to meet state and municipal needs’ (the Conditions) has entered into force.

Creating a national system of payment cards and other amendments to legislation regarding payment services

How companies in the oil and gas industries and construction companies that build oil and gas facilities may join the federal industry agreement for 2014 -2016
At federal level, the industry agreement has been adopted which sets additional obligations and automatically extends to companies in the oil and gas industries and to construction companies that build oil and gas facilities. To refuse to join the agreements, a well-grounded refusal should be submitted to the Russian Ministry of Labour and Social Protection by 13 May 2014.

The Russian Constitutional Court sets limitations for an administrative penalty lower than previously stipulated
Pepeliaev Group advises that on 25 February 2014, the Russian Constitutional Court adopted Resolution No. 4-P in which it recognised as universal the position that an administrative penalty may be imposed lower than previously stipulated set out in Resolution No. 1-P dated 17 January 2013. However, the Court has imposed some limitations on it being applied.

An administrative regulation has been approved for the Russian Ministry of industry and trade to perform the state function of licensing control over the manufacturing of medicines for medical use
Pepeliaev Group advises that on 3 March 2014 the Russian Ministry of Justice registered Order No. 1607 of the Russian Ministry of Industry and Trade dated 4 October 2013 "On approving the Administrative Regulation for the Russian Ministry of Industry and Trade to perform the state function of licensing control over the manufacturing of medicines for medical use" (the "Regulation").

JOINING THE FEDERAL INDUSTRY AGREEMENTS FOR THE PERIOD FROM 2014 TO 2016 IN THE AREAS OF ROAD FACILITIES, MOTOR, RAIL AND ABOVE-GROUND CITY PASSENGER TRANSPORT
At the federal level, industry-specific agreements have been entered into which set out additional obligations and automatically apply to companies working in the areas of road facilities, motor, rail and above-ground city passenger transport. To refuse to join the agreements, a well-grounded refusal should be submitted to the Russian Ministry of Labour and Social Protection by 25 March 2014.
